Any additional costs (e.g. testing fees, lab assessments, facility fees, equipment) are the client’s responsibility and are not covered by EVO.

11.6 Geographic and Residency-Based Pricing**

11.6.1 EVO applies residency-based pricing for all Services. This pricing model is based on legitimate commercial and regulatory factors, including differences in the cost of service delivery (such as international payment processing fees, foreign exchange costs, time-zone support, and regulatory compliance), local market economic conditions, and the regulatory environment in which the Services are consumed. The model also supports broader accessibility of professional sports science services within South Africa while enabling sustainable operations for international clients.

11.6.2 South African Residents shall be charged the rates published in South African Rand (ZAR) as set out in clause 4 (Package Details).

11.6.3 Non-Resident Clients shall be charged the rates published in Euro as set out in clause 4 (Package Details): €150 per month for the CORE Package and €125 per month for the LITE Package. These rates are determined with reference to international market positioning and the higher costs associated with delivering Services across borders.

11.6.4 All prices are quoted exclusive of applicable Value Added Tax (VAT) and any other taxes or duties. VAT and taxes shall be applied strictly in accordance with applicable law as follows:
(a) South African Residents: The standard rate of VAT (currently 15%) shall be charged and accounted for by EVO.
(b) Qualifying Non-Resident Clients: Services may be zero-rated for South African VAT purposes where the requirements of section 11(2)(l) of the Value-Added Tax Act 89 of 1991 (as amended) are satisfied, subject to EVO receiving and retaining satisfactory documentary proof of non-residency and confirmation that the Services are not rendered to any person physically present in South Africa at the time of supply.
(c) Clients residing in the European Union or other jurisdictions: Applicable destination-based VAT or equivalent taxes shall be charged in accordance with the laws of the jurisdiction in which the Client resides and consumes the Services. EVO reserves the right to adjust the invoiced amount to comply with such obligations.

11.6.5 At the time of onboarding, every Client (or the Parent or Legal Guardian where the Athlete is under 18 years of age) must complete a Residency Declaration. The Client warrants that the Residency Declaration is true, accurate, and complete, and that the Services will be primarily used and consumed in the declared country of residence.

11.6.6 EVO may, at any time and in its sole discretion, request reasonable proof of Residency. Such proof may include, but is not limited to, a copy of a valid identity document, passport, utility bill, or bank statement showing the billing address. The Client must provide the requested proof within seven (7) business days of EVO’s request.

11.6.7 If a Client’s Residency Declaration is incorrect, incomplete, or misleading, or if the Client fails to provide requested proof of Residency within the timeframe in clause 11.6.6:
(a) EVO may immediately re-price the Services at the correct rate applicable to the Client’s actual Residency, with retrospective effect from the date of the incorrect declaration;
(b) EVO may suspend or terminate the Services immediately without any refund of prepaid fees;
(c) The Client shall be liable for any additional VAT, taxes, costs, penalties, or charges incurred by EVO as a direct result of the incorrect or unverified declaration; and
(d) Such conduct shall constitute a material breach of this Agreement.

11.6.8 The pricing differentiation applied by EVO is based solely on the objective criterion of Residency and the commercial and regulatory factors set out in this clause 11.6. It is not applied on any prohibited ground of unfair discrimination under section 9 of the Constitution of the Republic of South Africa, the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000, or section 8 of the Consumer Protection Act 68 of 2008.

11.6.9 EVO reserves the right to review and adjust its geographic pricing model from time to time. Any material changes will be communicated in writing to affected Clients and will apply only to new subscriptions or renewals commencing after the effective date of the change, unless otherwise agreed in writing.

11.6.10 This clause 11.6 shall survive the termination or expiry of this Agreement for the purpose of any re-pricing, tax adjustment, recovery of amounts due, or enforcement of any rights or obligations arising from an incorrect Residency Declaration.
